VEHICLE STORAGE SPACE RENTAL AGREEMENT
Toy Storage - 9460 Vanguard Dr, Anchorage, AK 99507
Owner/Operator: Justin Walton, an individual, managing the storage lot at 9460 Vanguard Dr, Anchorage, AK 99507 (the "Property").
1. Rented Space; Storage Only. Owner rents to Renter the selected Space solely for outdoor storage of the one vehicle/item described above. This is space rental only - not a bailment; Owner does not take custody, care, or control of the stored vehicle (see Section 8). This does not waive Owner's statutory storage lien (Section 10).
2. Term (Month-to-Month). Begins on the Move-In Date above, continues month-to-month, auto-renews until terminated by either party with 30 days' written notice (email acceptable). Rent paid for the current month is non-refundable on early move-out.
3. Rent, Fees & Payment. Rent and late fee amounts for your selected Space are shown below and vary by size. Rent is due the 1st of each month, in advance. Returned payment fee: $35.00. Payment method: Stripe (credit or debit card). Owner may increase rent with 30 days' written notice.
4. Permitted Use. Renter may store only the one described vehicle/item. Renter shall NOT: live or reside in any stored vehicle or on the Property; store an unregistered, uninsured, inoperable, or leaking vehicle; perform repairs, fluid changes, or mechanical work on-site; store hazardous, flammable, or illegal materials; sublet or share the Space; connect to utilities or leave a vehicle running unattended; block aisles or gates or park outside the assigned Space.
5. Condition of Vehicle; Environmental Responsibility. Renter warrants the vehicle is registered, insured, operable, and free of leaks, and is solely responsible for any leak, spill, or contamination and related cleanup, remediation, or fines. Renter shall place and maintain a drip pan or ground cover beneath the vehicle; if Renter fails to, Owner may place one and bill Renter. Owner may require removal of a leaking or dripping vehicle.
6. Access; Rules. Access hours: 6:00 AM - 8:00 PM, every day. Gate/access code: 4012 (do not share). Traffic flow is one-way (in the north gate, out the south gate); obey posted signs and speed limits. The lot is an unpaved/graveled outdoor surface subject to snow, ice, mud, and weather; Owner does not guarantee snow removal, lighting, or year-round access. Renter enters and uses the Property at Renter's own risk. Owner may adopt reasonable written rules, which become part of this Agreement.
7. Insurance (Required). Renter shall maintain their own insurance covering the stored vehicle and its contents against theft, damage, fire, weather, and liability. Owner's insurance does not cover Renter's vehicle or property. Renter shall provide proof of insurance on request; lapse or absence of insurance is a default under Section 10.
8. No Bailment; Assumption of Risk; Release of Liability. Owner rents space only and is NOT a bailee, warehouseman, or custodian of the stored vehicle or its contents; Renter stores property at Renter's sole risk. TO THE FULLEST EXTENT PERMITTED BY LAW, RENTER RELEASES, WAIVES, AND HOLDS HARMLESS OWNER AND ITS MEMBERS, AGENTS, AND EMPLOYEES FROM ANY AND ALL LOSS, THEFT, VANDALISM, FIRE, WEATHER, COLLISION, DAMAGE, OR INJURY TO THE STORED VEHICLE, ITS CONTENTS, OR ANY PERSON OR PROPERTY ON THE PROPERTY, REGARDLESS OF CAUSE, INCLUDING OWNER'S ORDINARY NEGLIGENCE - EXCEPT FOR LOSS OR INJURY CAUSED BY OWNER'S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT. Owner is not responsible for any damage, loss, or theft of the vehicle or any items left in or on it. By checking the release box and signing below, Renter confirms having read and understood this release.
9. Indemnification. Renter shall indemnify and defend Owner against claims, damages, liabilities, fines, or costs (including reasonable attorney's fees) arising from Renter's use of the Space, the stored vehicle, any leak/spill, or Renter's breach of this Agreement. This does not extend to Owner's own gross negligence or willful misconduct.
10. Default; Storage Lien; Removal of Unpaid or Abandoned Vehicles. Renter is in default if rent is unpaid when due or Renter breaches any term. Renter grants Owner a lien on the stored vehicle and contents for unpaid rent, late fees, and reasonable enforcement costs, consistent with the self-storage facility lien under AS 34.35.600-34.35.695. If rent is 10+ days past due, Owner may deny access until paid. Owner may enforce the lien only after 10 continuous days of default and a notice sent by email AND certified mail stating the amount due and a cure date of at least 20 days out; if not cured, Owner may sell or dispose of the vehicle under AS 34.35.635. A vehicle left without consent for 30+ days, or 30+ days after termination/non-payment, is deemed abandoned and may be processed under AS 28.11.025 (title transfer via DMV after required notice). Owner will not sell, dispose of, or transfer title except through this statutory process; all towing, storage, notice, and sale costs are chargeable to Renter.
11. Termination. Either party may terminate with 30 days' written notice. Owner may terminate immediately for non-payment, unsafe/leaking vehicles, illegal activity, or material breach. On termination, Renter shall remove the vehicle and leave the Space clean; otherwise Section 10 applies.
12. General. Governing law/venue: State of Alaska, venue in Anchorage. Prevailing party in any dispute recovers reasonable attorney's fees and costs. This is the entire agreement, changeable only in writing signed by both parties; if any part is unenforceable the rest remains in effect. Renter certifies the vehicle information provided is accurate and that Renter is the legal owner or authorized to store it.
Not legal advice - one item is still pending confirmation: whether AS 34.35's self-storage lien statute applies to an outdoor lot (vs. enclosed units only). If it does not, the abandoned-vehicle process in Section 10 (AS 28.11.025) plus the contractual lien grant is the fallback.
